Amendments to the code of ethics of physicians

Amendments to the code of ethics of physicians will take effect tomorrow, January 7, 2015. Here is an extract of the news bulletin available on the Collège des médecins du Québec (CMQ) website:

The Code of ethics of physicians adapted to today’s reality to better protect the public.

In the past months, the Collège des médecins du Québec proceeded with the revision of the Code of ethics of physicians to better protect the public. The amendments to the Code of ethics, which was published on December 23, 2014 in the Gazette officielle du Québec (GOQ), will take effect on January 7. However, certain articles that pertain to the independence and impartiality will not take effect until July 7, 2015.

“The last revision of the Code of ethics was in 2002, with the exception of some additions of articles on leases in 2008 and on advertising in 2010. For this new revision, the Collège took into account recurring issues raised with the Department of investigations, disciplinary decisions rendered and the evolution of medical practice and new technologies. The revised Code emphasizes on transparency, integrity and professionalism that we demand from the part of the physicians” said Dr. Charles Bernard, president and CEO of the Collège des médecins.

We find in the new Code provisions on interdisciplinarity, the management and monitoring of patients, accessibility to medical records and medical expertise. In addition, it will now be prohibited for physicians to receive a financial advantage other than their fees when prescribing devices, examinations or medications. In this regard, an exception was provided to the rule for physicians who participated in the development of the product prescribed as the objective of the Collège is not to discourage the participation of physicians in research and development. However, doctors will have an ethical obligation to inform patients of their interests in the company that is marketing the product. (…)

Note that this is our translation of the article as the Collège publishes its bulletin only in French. Further information, and the full text in French, dated January 5 2015, is available on the CMQ website:
